EPA 316(B) Rule Applied to Hydroelectric Facilities

Recent EPA Actions

On February 14, 2023, EPA’s Region 1 (New England) released a new NPDES General Permit (GP) for discharges from hydroelectric facilities located in Massachusetts and New Hampshire. The GP’s effective date is April 15, 2023. Operators seeking authorization to discharge must submit a complete and accurate Notice of Intent (NOI) within sixty (60) days of the effective date of this GP, or by June 14, 2023.

The Permittee must comply with the following requirements within 180 days of receiving authorization to discharge under the permit.                                               

Permittees are required to satisfy 316(b) impingement mortality by demonstrating compliance with one of the four options you can find in the PDF.                                      

Permittees are required to prepare a Best Management Practices plan for compliance with the terms of the GP the objectives of the BMP plan.                              

When state or federally listed endangered species are present, permit coverage will only be available if EPA determines, or the applicant determines and EPA concurs.
